1. What this page covers
This page covers the rights ArkCloud Health grants to you: how the software is licensed to customers, and the rules for using our name, logo and product names.
If you are looking for the open source software this platform is built on and the licences it is used under, that is the open source licences page instead.
2. How the software is licensed
The platform is proprietary software delivered as a hosted service. A subscription grants a limited, non-exclusive, non-transferable, revocable right to access and use the service for your organisation’s internal business purposes, for the term and within the limits set out in your order or in the Terms of Service.
2.1 What a subscription does not grant
- Any ownership of the software, the platform, or any part of either. We retain all right, title and interest in them.
- A copy of the software. It is provided as a service; there is no on-premise licence, and no source code is delivered.
- A right to sublicense, resell, rent, lease, or provide the service to a third party as a service of your own, unless your agreement expressly says otherwise.
- A right to reverse engineer, decompile or disassemble the platform, or to derive its source code, except where that restriction is unenforceable under applicable law.
- A right to copy, modify or create derivative works of the platform or of our documentation.
- Any patent licence. See the patents page for our position on that.
2.2 Your data stays yours
Licensing the software to you does not give us ownership of what you put into it. Your data - including Protected Health Information - remains yours, and we process it on your instructions under your agreement and the applicable Business Associate Agreement. How that processing works is described in the Privacy Policy and the HIPAA safeguards page.
3. Evaluations, demonstrations and trials
Access granted for evaluation, demonstration or trial is licensed for evaluation only. It is not licensed for production use, must not be used with real patient data unless a Business Associate Agreement is in place first, and may be withdrawn at any time. Any service level or support commitment in a paid agreement does not apply to it.
4. Our name and marks
The following are trademarks of ArkCloud Health, whether or not marked with a symbol on any given page:
- ArkCloud Health and ArkCloud, together with the ArkCloud logo and wordmark.
- ArkCloud RCM
- ArkCloud Rehab
- ArkCloud Clinical
4.1 Use you do not need to ask about
- Referring to us or to our products by name in plain text - in an article, a review, a comparison, a job posting or a conference programme.
- Stating truthfully that your organisation uses the platform.
- Quoting our published material with attribution.
In each case use the product name as it is written above, without abbreviating it, translating it, pluralising it or making it a verb, and do not use it in a way that suggests we sponsor or endorse you.
4.2 Use that needs written permission
- Using our logo or wordmark in your own marketing, on your website, in a deck, or on merchandise.
- Using our name or marks in your company name, product name, domain name, social media handle or app name.
- Naming us as a customer, partner or integration in a way that implies a relationship that is not in a signed agreement.
- Altering the logo - recolouring it, redrawing it, adding to it, or setting it in a different typeface.
- Any use that could imply endorsement, certification, affiliation or a joint offering.

5. Products not yet generally available
Not everything named above is buyable today
Some products listed in section 4 are named and reserved but not yet generally available. A name being protected as a mark is not a statement that the product exists to be licensed. The products pages state the status of each one, and nothing that has not shipped is described there in the present tense.
6. Enforcement
We reserve every right in our software and marks that is not expressly granted, and our failure to act on a particular misuse is not a waiver of the right to act on it or on any other. Use outside the permissions on this page may be trademark infringement, copyright infringement, or a breach of your agreement.

This page summarises licensing terms for general guidance. Where it differs from a signed agreement between you and ArkCloud Health, the signed agreement governs. Third-party names mentioned anywhere on this site are the marks of their respective owners.
