United States patent law allows a patent holder to give notice of its patents by publishing them at a fixed web address rather than marking each product physically. This is that address for ArkCloud Health.

It is published now, before there is anything to list, so that the address is stable and so that this notice can be relied on from the day any patent issues.

Our intellectual property in the platform rests on copyright, trade secret and trademark rather than on patents. See Licensing for what that means for your use of the software and of our name.

Nothing on this page, and nothing in your use of the platform, grants you any licence - express, implied, by estoppel or otherwise - under any patent, patent application or other intellectual property right held now or in the future by ArkCloud Health. Your rights are those set out in the Terms of Service or in your signed agreement, and no more.

Equally, the absence of a patent listed here is not a statement about anyone else’s patents, and it is not permission to copy the platform. Copyright subsists in the software regardless.

Some of the open source components the platform is built on are distributed under the Apache License 2.0, which carries an express patent grant from its contributors, and terminates that grant for a party who brings patent litigation over the work. Those grants run from the contributors of each project to you directly under that licence. They are not grants from ArkCloud Health, and we neither extend nor restrict them.

If you believe the platform infringes a patent you hold or represent, write to [email protected] identifying the patent number, the claims you believe are implicated, and the feature or behaviour you believe reads on them. We will acknowledge receipt and review it.

Sending such a notice does not create any obligation on our part beyond review, and does not constitute an admission of any kind by either of us.
